한국에서 지역정당(local party)은 어떻게 가능할 수 있을까? : 지방자치법 전면개정과 ‘주민자치정당’ 허용 방안을 중심으로

본 연구의 문제의식은 지난 20여 년간 반복돼 온 지역정당 운동의 실패를 되풀이 하지않기 위해서는 어떤 방식의 이론적, 실천적 접근이 필요한지에 대한 물음에서 시작된다. 그동안 정당 설립요건을 엄격하게 규정하고 있는 현행 정당법을 개정하기 위한 노력은 계속돼 왔지만 사실상 아무런 성과도 거두지 못했다. 이러한 상황을 타개하기 위해 본 논문에서 주목하는 것은 지방자치법 전면 개정에 따른 정치적 환경의 변화이다. 즉, 지방자치단체의 구성자치권(structural autonomy)이 강조됨으로써 지역정당 설립에대한 새로운 법적, 논리적 근거가 마련되었다고 보는 것이다. 변화된 지방자치의 환경 속에서 기존과는 다른 접근법을 통해 지역정당 설립이 가능할수 있는 방법을 모색해보는 것이 본 연구의 목적이다. 이에 따라 전국정당과 지역정당을 서로 다른 규율체계로 편입시키는 이원적 시스템을 상정하고, 지역정당은 전면 개정된 지방자치법에 터를 잡아 ‘주민자치정당’의 형태로 허용하는 방안을 집중적으로 논의하였다. 지역정당 설립 운동의 방향 전환을 강조한 것이다. The problem consciousness of this study begins with the question of what kind of theoretical and practical approaches are needed to avoid repeating the failure of the local party movement that has been repeated for the past 20 years. Efforts have been made to revise the current party law, which strictly stipulates the requirements for establishing a political party, but virtually no results have been achieved. To overcome this situation, this paper pays attention to changes in the political environment following the complete revision of the Local Government Act. In other words, it is believed that a new legal and logical basis for the formation of local parties has been established by emphasizing the structural autonomy of local governments. The purpose of this study is to find a way to establish a local party through a different approach in the changed environment of local autonomy. A dual system was proposed to incorporate national and local parties into different regulatory systems, and local parties were intensively discussed about the ways to allow them in the form of ‘Residents' Party’ based on the revised Local Government Act.
