지방자치단체의 주민소환제도 개선방안에 관한 연구

본 연구는 주민소환제의 운영실태를 분석하여 제도의 개선방안을 모색하는 데 있다. 주민소환제는 주민들에게 선출직공직자에게 해임 권한까지 부여하여 행정의 책임성을 높일 수 있다. 특히, 현행 주민소환제도는 어떤 문제점이 있는지를 살펴보고 운영상의 개선방안을 모색하고자 하였다. 첫째, 주민소환의 대상은 형평성 차원에서 선출직 공직자와 정무직 공직자 까지 확대해야 한다. 둘째, 주민소환사유는 권력의 오·남용의 문제를 방지하기 위해 책임성 여부를 명확하게 제시해야 한다. 셋째, 주민소환투표와 소환선거 이후의 후임자 승계까지 고려해야 한다. 넷째, 주민소환대상자의 권한정지는 2주일 이내로 제한 하도록 명시하는 것이 필요하다. 다섯째, 주민소환의 소요경비는 선거기탁금제도를 활용해 볼 수 있다. 여섯째, 주민소환제 남용을 방지하기 위한 보완장치로 주민소환조정위원회를 설치해 볼 수 있다. This study is to analyze the operation status of the resident recall system and to find ways to improve the system. The resident recall system can give residents the authority to dismiss elected officials, thereby enhancing the responsibility of the administration. In particular, the current resident recall system was intended to examine the problems and seek ways to improve the operation. First, the subjects of recall of residents should be expanded to include elected officials and political officials for equity. Second, the reasons for recall of residents should clearly state whether they are responsible to prevent problems of misuse or abuse of power. Third, the government should consider the residents' recall vote and succession of their successors after the recall election. Fourth, it is necessary to specify that the suspension of authority of persons subject to recall of residents is limited to two weeks. Fifth, the required expenses for recall of residents can be used by the election deposit system. Sixth, a resident recall coordination committee can be established as a supplementary device to prevent abuse of the resident recall system. KCI Citation Count: 0
