어느새 한국에서도 ‘단일민족’이라는 단어는 과거 속으로 사라진 역사적 단어가 되어가고, 그로 인하여 다민족국가라기보다는 ‘다인종 국가’라는 단어가 등장하게 되었으며, 이에 따라 ‘다문화’라는 단어가 1990년대 이후부터 외국인구의 유입으로 자연스럽게 만들어진 단어이기도 하다. 이는 인간이 언제 어디서나 누구나 행복하게 살 수 있는 권리-인간과 시민으로서의 행복을 추구할(헌법 제10조)-를 다문화라는 용어 속에는 원천적으로 자국문화와 타국문화라는 구별로 인하여 오히려 차별로 연결될 수 있다는 것에 그 헌법적 의미가 있다 할 것이다. 그리하여 본 논문에서는 한국에 있어서의 다문화의 헌법적 개념(II)과, 이러한 다문화의 사회통합적 유형과 인권을 중심으로, 그 주된 내용으로는 1. 국적취득, 2. 多文化와 敎育, 3. 외국인 노동자의 인권(III)을 집중 조명할 것이다본 논문의 목차는 다음과 같다. Ⅰ. 序說Ⅱ. 한국에서의 다문화주의에 대한 헌법적 개념Ⅲ. 한국에서의 다문화주의의 사회통합적 유형과 인권1. 결혼이민자의 국적취득2. 多文化와 敎育3. 외국인 노동자의 인권Ⅳ. 結語 A sentence that ‘Korea is a single-race nation’ has been words of the past in Korea. Instead, a phrase of ‘Multiracial state’, rather than ‘Multinational state’, has appeared, and the word of ‘Multiculture’ has been naturally created due to the increase of foreign population in Korea since the 1990s. Human beings have the right to live happy wherever or whoever they are, and this is called the right to pursue happiness (Article 10 of the Constitution). With respect to this right to be naturally pursued by human beings and citizens, the term of ‘Multiculture’ contains the distinction between Home Culture and Alien Culture. Therefore, a constitutional significance hereof lies in the differentiation that may be caused by the distinction between Home and Alien Culture. This thesis deals with a constitutional concept about multiculturalism in Korea (II), and social integration types about multiculturalism and human rights, of which details focus on various matters related to (1) acquisition of nationality; (2) multiculturalism and education; and (3) human rights of foreign workers in Korea.
