비정규직 문제의 쟁점과 과제: 비정규직보호법을 중심으로

한국의 비정규직 문제는 1990년대 이래 기업들이 고용구조의 유연화 전략을 내세우면서 시작되어 IMF 외환위기를 거치면서 심화되었다. 이는 노동시장 전반에서 전개되고 있으며 정규상용직이 주축을 이루던 관리직과 전문직에도 확대되고 있다. 본 연구는 이러한 배경에서 지난 2007년 7월부터 시행되고 있는 비정규직보호법을 중심으로 쟁점과 과제를 탐색하고 있다. 비정규노동의 이론적 배경, 노동시장의 유연성과 엄격성, 비정규직보호법의 현황·쟁점·과제 등에 관한 것이다. 법으로 고용안정을 달성하겠다는 것은 참으로 어려운 정책의제이다. 비정규직 문제의 해결은 임금의 유연성과 고용의 유연성이 맞교환 될 때 해결의 가능성이 있다. 기업은 비정규직 고용문제를 사회적 책임의 차원에서 다루고, 노동조합은 노조의 사회적 책임이라는 영역에서 비정규직 문제를 바라봄으로써 문제해결의 실마리가 있는 것이다. The problem of non-regular workers in korea has begun as the enterprises asserted the strategy of flexibility of employment and deepened since 1990s` IMF crisis. This is shown in overall labor-market including managerial and professional parts. This study looks into issues and tasks concerning the non-regular workers protection bills since July of 2007, which is about the theoretical background of non-labor workers, the flexibility and rigidity of labor-market, the aspect, issues and tasks of non-regular workers protection bills etc. The stable employment through laws is very hard to accomplish. The solution of non-regular workers problem can be achieved by the exchange of the flexibility of wages and that of employment. The enterprises and the labors` union should see this problem as the social responsibility.
