해양주권 강화를 위한 해양경계획정에 관한 연구

오늘날 각국은 국가안보, 경제적 이익 등 국익을 추구하기 위해 해양력을 신장하거나 해양주권을 확보·행사하는 데 많은 노력을 기울여 왔다. 해양의 중요성은 제2차세계대전 이후 선진국을 중심으로 국제사회에서 크게 부각되어 왔다. 우리나라는 반도국으로서 지정학적 특수성이 있음에도 불구하고 그동안 해양으로의 진출과 해양지배의 중요성에 대한 인식이 미흡했다. 21세기 신해양시대에 우리 주변 해양의 이용과 지배에 대한 국가적 중요성은 아무리 강조해도 지나치지 않다. 해양에서의 주권 행사는 대체로 해군, 해양경찰 등 군과 국가기관의 행위로 이루어지며, 이는 해양 국경이 명확히 획정되었을 때 법적, 외교적 부담 없이 더욱 효과적으로 실현될 수 있을 것이다. 해양에 대한 국가관할권을 지속적이고 안정적으로행사하기 위해서라도 해양경계획정을 명확히 하는 것이 필요하다. 이를 위해 우리는해양경계획정에 대한 지속적인 연구를 통해 주변국과의 교착 상황에 대한 실마리를풀어 나가야 할 것이다. 이 연구에서는 해양경계 획정의 의의 및 그 관련이론, 해양경계 분쟁 및 경계 획정 사례를 검토한 후 우리나라의 과제에 대해 짚어보았다. Today, States have endeavored to enhance maritime power and to secure and exercise maritime sovereignty. The importance of maritime dominance has increased within the international community of developed States-centered. South Korea as a peninsula has special geo-political features but has not had enough recognition of the importance of maritime-oriented initiative and the importance of the dominance of the seas. In the 21st Century of the new ocean era, the nationwide importance of using and ruling the seas cannot be emphasized enough. The exercise of maritime sovereignty can be made through the exercise of naval or maritime police power, which can be more clearly and strongly realized without legal and diplomatic burdens when maritime boundaries are clearly delimited. The clear maritime boundaries are necessary in order to consistently and stably exercise State jurisdiction over the seas. Thus we need to develop ways to break the situation of stalemate through consistent research on maritime boundary delimitation. This paper has discussed the task of Korea through reviewing the significance of maritime boundary delimitation, its related theories, and cases of maritime boundary disputes and maritime boundary delimitation. As our task, we need to continue to collect historical data related to maritime sovereignty, study the international legal logic, and establish firm maritime boundaries based on it to strengthen our maritime sovereignty.
