O instituto da tomada de decisão apoiada: uma análise sobre o objeto e os sujeitos

O trabalho visa compreender o objeto e os sujeitos do instituto da tomada de decisão apoiada. Discorrer-se-á acerca dos parâmetros legislativos que inovaram no ordenamento jurídico prevendo o instituto legal que salvaguarda os interesses das pessoas com deficiência e demais vulneráveis, criando um gênero de apoio intermediário, que atua paralelamente à curatela e à tutela. O método empregado é a revisão bibliográfica. Ao final, conclui-se que a tomada de decisão apoiada seria a medida que mais resguardaria a autonomia privada dos deficientes, não alterando a capacidade civil de fato dos apoiados, mas criando uma esfera que preserva a autodeterminação e a segurança jurídica. The work aims to understand the object and subjects of the institute of supported decision making. It will be discussed about the legislative parameters that innovated in the order providing the legal institute that safeguards the interests of the disabled and other vulnerable, creating a kind of intermediary support, which acts in parallel with the curatorship and the guardianship. The method used is the literature review. In the end, it is concluded that supported decision-making would be the measure that would most protect the private autonomy of the disabled, not changing the de facto civil capacity of those supported, but creating a sphere that preserves self-determination and legal certainty.
