국민연금제도 개선 방안에 관한 연구 - 분할연금을 중심으로

본 논문은 분할연금의 주요쟁점사항을 분석하고 그 개선방향을 모색하는 것을 목적으로 한다. 인구고령화가 급속도로 진행되는 가운데 가족중시의 전통적 가치관의 변화로 점점 증가하고 있는 노년의 이혼은 국민의 노후보장을 뒷받침하는 사회보장제도로서의 국민연금의 중요성을 더욱 부각시키고 있다. 특히, 분할연금은 혼인기간 중 연금납부에 기여한 부분에 대한 상대방 배우자의 당연한 독립적 권리이자 단순한 재산권적 성격을 넘어선 사회보장적 성격을 가지는 권리이므로 분할연금의 합리적 보장방안이 중요하다. 1999년 분할연금을 도입한 이래 2007년에는 분할연금의 독립적 성격을 강화하는 방향으로 개정을 했지만, 여전히 분할연금수급권을 합리적으로 보장하기 위한 방안에 대한 논쟁사항이 있다. 우선, 이혼시 법원에서 화해조서에 분할연금에 대한 합의사항이 없을 경우에 재산분할에 대한 합의와 상관없이 사회권적 기본권의 보장으로서 분할연금청구가 인정된다. 또한, 분할연금을 형평성 있게 보장하기 위해서는 실질적 혼인기간을 정확히 산정하는 것이 중요하며, 비록 분할연금 지연청구에 의해 수급권이 소멸했을지라도 이혼한 배우자의 분할연금을 모두 인정하는 방향으로 입법을 하는 것이 필요하다. 마지막으로 분할연금의 독립적인 성격을 강조하는 2007년 국민연금법 개정으로 분할연금수급자의 사망시 분할연금은 소멸된다. 하지만 분할연금수급자의 유족연금은 여전히 인정되지 않아 입법적으로는 논리적 흠결이 있다. 반면에 분할연금의 독립적 성격의 강조로 인해 재혼한 배우자와 유책배우자의 분할연금수급권은 보장되고 있다. 향후 분할연금을 보다 더 합리적으로 운영하는 방향으로 연구와 논의가 진행되어야 한다. This paper aims to analyze the main issues of divided pensions and to find ways to improve them. As the population aging progresses rapidly, the divorce of old age further emphasizes the importance of the national pension as a social security system to support the retirement of the people. In particular, the divided pension is an independent right of the other spouse's contribution to the payment of pension during the marriage period and a social security characteristic that goes beyond simple property rights. Since the introduction of the divided pension in 1999, the amendment was made to strengthen the independent character of the divided pension in 2007, but there is still a debate on how to secure the rational pension entitlement. First of all, if there is no agreement on divided pension in the settlement agreement at the time of divorce, the divided pension claim is granted as a guarantee of basic social rights regardless of the agreement on property division. In addition, it is important to accurately calculate the actual marriage period in order to guarantee the divided pension equitably, and even if the right of eligibility is extinguished by claiming the divided pension after the deadline, it is necessary to legislate in order to accept the divided pension of the divorced spouse. Lastly, the amendment to the National Pension Act in 2007 causes the divided pension to expire when the pensioners die. However, survivors' pensions for divided pensioners are still unacceptable and have legislative defects. On the other hand, the emphasis on the independent character of divided pension guarantees the divided pension entitlement of remarried spouses and spouses responsible for divorce. In the future, research and discussion should proceed toward more rational operation of the divided pension. KCI Citation Count: 0
